These terms and conditions outline the rules and regulations for the use of GymOnLondon’s (the “Company”) website. Please read these terms and conditions in conjunction with any document provided to you electronically, whether it is membership related or not. GymOnLondon is located at: 2 Chatfield Road, London, SW11 3SD. By accessing this website we assume you accept these terms and conditions in full. Do not continue to use GymOnLondon’s website if you do not accept all of the terms and conditions stated on this page. The following terminology applies to these Terms and Conditions and the Privacy Statement: “member”, “you” and “your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “GymOnLondon”, “the company”, “ourselves”, “we”, “our” and “us”, refers to our company.
Our website is purely for personal and non-commercial use. You may access and download any of the contents and store it on a temporary basis for your own personal use. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link from any website that is not owned by you. Our website must not be framed on any other website, nor may you create a link to any part of our website other than the home page. We reserve the right to withdraw linking permission without notice. RESERVATION OF RIGHTS
ACCEPTANCE OF MEMBERSHIP
The decision to accept the application of a potential member shall be at the sole discretion of GymOnLondon. GymOnLondon reserves the right to verify, or require proof of all information given in order to obtain membership and any fraudulent or wrongful information given in order to obtain such membership could result in the cancellation of all membership rights and lead to the repayment of all monies due to GymOnLondon. If the membership application is accepted by GymOnLondon, membership of GymOnLondon by the applicant shall commence as stated in the agreement. The acceptance of an application for membership of GymOnLondon shall constitute a legally binding agreement between the member and the us.
You may be required to register with the website. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
FEES AND PAYMENT
We accept the following forms of payment: Visa, MasterCard, American Express, PayPal. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the website. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. We bill you through an online billing account for purchases made via the website. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in GBP.
You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such amounts upon making your purchase. If your purchase is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until you notify us of your cancellation.
We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We also reserve the right to refuse any order placed through the Website.
CANCELLATION AND CAUSES FOR EARLY TERMINATION
The following reasons may be acceptable to GymOnLondon subject to formal agreement for early termination. Termination requests will only be accepted and applied from the date of written correspondence received by us:
- Illness or Injury: Letter from GP or referring Doctor required
- Re-Location: Proof of relocation out of the area is required
- Bankruptcy: proof required
Written correspondence must be addressed to firstname.lastname@example.org. To cancel a monthly deferred payment membership an email must be sent to us by email requesting to do so. If the minimum term has surpassed, then one further full payment will be taken from the date of this correspondence. If early termination criteria is not met then monthly deferred payment memberships are subject to one full payments notice from the date of the cancellation request post minimum term. Annual upfront membership will run until the anniversary date. This membership is non-refundable and will not renew without payment. Upfront memberships are non-refundable. PHYSICAL HEALTH OF MEMBER
By becoming a member of GymOnLondon, you warrant and also represent that you are in good health and you are not incapable of engaging in either active or passive exercise. The member further warrants that such exercise or any use of GymLondon’s facilities would not be detrimental to their health, safety, comfort, well-being or physical condition. GymOnLondon takes no liability for any injury caused by your own negligence. Before you start using GymOnLondon’s facilities, you must inform a member of staff of any injury’s you may have immediately. If you intend to take part in any class related activities, you must similarly, inform a member of staff of any injuries you may have immediately.
From time to time we may need to increase the price of membership. We will give you at least 15 day’s notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase.
We use social media as part of our marketing strategy and as part of our day-to-day business. From time to time, we may use videos, audio and images of you using the GymOnLondon facilities to aide our marketing strategy. By agreeing to these terms, you warrant us the right to use your images, audio and videos for this purpose. All images, audio and videos taken by us of you using the GymOnLondon’s facilities are solely owned by us and will remain this way unless expressly agreed between you and us. The following are some of the social media sites we may use: Instagram; Facebook; YouTube; and Twitter. This list is not exhaustive and if you would like further information, you can request this in writing by emailing firstname.lastname@example.org.
THIRD-PARTY WEBSITES AND CONTENT
Our website may offer links to other websites. However, GymOnLondon assumes no responsibility for the contents of these websites and may have no control over the content of these sites. The use of links to other websites does not mean that GymOnLondon endorses, approves or sponsors any material or service found on these websites. Any contract for goods or services entered into with these websites will be made with the owners/controllers of those websites and not with GymOnLondon.
We reserve the right to change, modify, or remove the contents of the website at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Website without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Website. We cannot guarantee the Website will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the website, resulting in interruptions, delays, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Website during any downtime or discontinuance of the Website.
